These Terms of Service (“Terms”) govern your use of services provided by HVAC Loyalty (“we,” “us,” or “our”) and your use of the website located at hvacloyalty.com (the “Site”). By scheduling service, requesting an estimate, or using our Site, you (“Customer,” “you,” or “your”) agree to these Terms.
1. Acceptance of Terms
By engaging HVAC Loyalty for HVAC services, signing a service agreement, accepting an estimate, or otherwise authorizing work to begin, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are accepting these Terms on behalf of a business, organization, or other entity, you represent that you have authority to do so.
These Terms apply in addition to any specific service agreement, work order, or written estimate signed between you and HVAC Loyalty. In the event of a conflict between these Terms and a signed service agreement, the signed service agreement controls.
2. Services Provided
HVAC Loyalty is a licensed HVAC contractor providing heating, ventilation, and air conditioning services across Miami-Dade, Broward, and Central Florida. Our services include but are not limited to:
- Air conditioning repair, installation, replacement, and maintenance
- Heat pump repair, installation, and maintenance
- Heating system service and installation
- Ductless mini-split installation and service
- Indoor air quality systems including UV, filtration, and ventilation
- Whole-home dehumidifier installation
- Mold prevention and salt-air protection systems
- Emergency 24/7 dispatch service for non-functioning systems
All work is performed by licensed Florida HVAC technicians in accordance with applicable Florida Construction Industry Licensing Board (CILB) requirements and local building codes.
3. Scheduling, Estimates, and Service Calls
Estimates. We provide written estimates for all installations and major repairs. Estimates are valid for thirty (30) days from the date issued unless otherwise noted. Estimates may be adjusted if conditions discovered during work materially differ from those visible at the time of inspection (e.g., hidden damage, code violations, or required upgrades discovered after disassembly).
Service Call Fee. Standard service calls include a diagnostic fee disclosed at the time of scheduling. The diagnostic fee covers the technician’s travel to your property, diagnosis of the system issue, and a written quote for repair. The diagnostic fee is owed whether or not you proceed with the recommended repair.
Same-Day Service. We make reasonable efforts to dispatch same-day for service calls received before 12:00 PM local time. Same-day service is not guaranteed and depends on technician availability, weather conditions, and call volume.
4. Pricing, Payment, and Refunds
Pricing. All pricing for repair and installation work is provided in writing before work begins. We use flat-rate pricing for most repairs based on standard repair guides. Hourly billing applies only when explicitly stated in the work order.
Payment Terms. Payment is due upon completion of work unless other terms are agreed in writing. We accept all major credit cards, debit cards, ACH transfers, and approved business checks. Financing options through approved third-party lenders may be available for installations and major repairs.
Late Payment. Invoices unpaid more than thirty (30) days past due may incur a late fee of one and one-half percent (1.5%) per month or the maximum amount permitted by Florida law, whichever is less. Customer is responsible for reasonable collection costs and attorneys’ fees on collection of unpaid balances.
Refunds. Refunds for completed work are evaluated on a case-by-case basis. We do not provide refunds for diagnostic fees once a diagnosis has been performed and a written quote provided. Equipment installations are subject to manufacturer return policies and may be subject to restocking fees.
Sales Tax. Florida sales tax is added to all taxable items per current Florida Department of Revenue rates.
5. Workmanship Warranty
HVAC Loyalty warrants the workmanship on labor performed by our technicians for a period of one (1) year from the date of service, unless a longer warranty is specifically stated in the written work order. This warranty covers defects in our installation or repair work and does not cover:
- Equipment malfunctions covered under the manufacturer’s separate warranty (see Section 6)
- Damage caused by improper use, lack of maintenance, power surges, or extreme weather events
- Damage caused by other contractors, the customer, or third parties working on the system
- Issues arising from pre-existing conditions disclosed at the time of service
- Cosmetic damage to surrounding finishes that we noted at the time of service
Warranty service requires that HVAC Loyalty be notified within the warranty period and granted reasonable access to inspect and repair the issue. Warranty service is provided during standard business hours unless emergency service is required.
6. Equipment Warranties
HVAC equipment installed by HVAC Loyalty is covered by the equipment manufacturer’s warranty, which is separate from our workmanship warranty. Manufacturer warranty terms vary by brand and model and are typically printed on warranty cards delivered with the equipment or available through manufacturer registration.
To activate manufacturer warranties, equipment must typically be registered within sixty (60) days of installation. We register equipment on your behalf when possible but recommend you verify registration directly with the manufacturer. Failure to register equipment may reduce or void manufacturer warranty coverage.
Manufacturer warranties typically require regular maintenance to remain valid. Warranty service for manufacturer defects may be performed by HVAC Loyalty on the manufacturer’s behalf, with parts covered under warranty and labor billed at our standard service rates unless a separate parts-and-labor warranty was purchased.
7. Property Access and Customer Responsibilities
To complete work efficiently and safely, you agree to:
- Provide reasonable access to all relevant areas of the property including indoor air handlers, outdoor condenser units, ductwork, electrical panels, and attic or crawlspace areas
- Disclose known hazards including pets, hostile animals, asbestos, mold, structural issues, or property security concerns
- Move personal items, furniture, or fragile objects away from work areas before our technicians arrive
- Ensure that an adult (18+) authorized to make decisions about the work is present or reachable by phone during the service appointment
- Comply with HOA, condo association, or property management approval requirements that you are responsible for obtaining
HVAC Loyalty is not responsible for delays, additional charges, or work limitations caused by access restrictions, undisclosed hazards, or HOA/property approval issues outside our control.
8. Cancellation and Rescheduling
Service appointments may be cancelled or rescheduled with at least twenty-four (24) hours notice without charge. Cancellations made with less than twenty-four (24) hours notice may be subject to a service call fee equal to our standard diagnostic fee.
HVAC Loyalty reserves the right to reschedule appointments due to weather emergencies, technician illness, parts availability, or other circumstances beyond our reasonable control. We will notify you as soon as practical and offer the next available appointment.
9. Emergency and After-Hours Service
We provide 24/7 emergency dispatch for HVAC system failures. Emergency service rates apply outside standard business hours (7:00 AM–7:00 PM, Monday through Saturday, excluding major holidays). Emergency service rates are disclosed at the time of dispatch.
An emergency for purposes of after-hours dispatch is generally defined as a complete system failure during extreme weather, water leaking from the system, or refrigerant leaks. Non-emergency requests during after-hours may be scheduled for the next business day.
10. Limitation of Liability
NO WARRANTY EXCEPT AS STATED. EXCEPT FOR THE EXPRESS WARRANTIES STATED IN SECTIONS 5 AND 6, HVAC LOYALTY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
LIABILITY CAP. TO THE MAXIMUM EXTENT PERMITTED BY FLORIDA LAW, HVAC LOYALTY’S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO ANY SERVICE OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM. IN NO EVENT SHALL HVAC LOYALTY BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow exclusion of certain warranties or limitation of liability for consequential damages, so the above limitations may not apply to you in their entirety.
Insurance. HVAC Loyalty maintains general liability and workers’ compensation insurance as required by Florida law. Certificates of insurance are available upon written request.
11. Dispute Resolution
Direct Negotiation First. If a dispute arises, the parties agree to first attempt resolution through good-faith direct discussion within fifteen (15) days of written notice from the complaining party.
Binding Arbitration. If direct negotiation fails to resolve the dispute within thirty (30) days of written notice, all disputes arising out of or related to these Terms or any services provided shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall take place in Miami-Dade County, Florida unless otherwise agreed by the parties.
Class Action Waiver. You agree that disputes will be resolved on an individual basis and waive any right to participate in class actions, collective actions, or representative proceedings against HVAC Loyalty.
Small Claims Exception. Either party may bring claims in small claims court for matters within the jurisdictional limits of that court ($8,000 in Florida) without first attempting arbitration.
Governing Law. These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Where arbitration is unavailable, exclusive venue lies in the state and federal courts of Miami-Dade County, Florida.
12. Website Use Terms
Permitted Use. The Site is provided for personal, non-commercial use to learn about our services, request quotes, and contact us. You may not use the Site for any unlawful purpose, to harm minors, to transmit malware, to scrape content for commercial use, or to interfere with the Site’s operation.
No Warranty on Site Content. Site content is provided “as is” for informational purposes. While we strive to keep information accurate, we do not warrant the accuracy, completeness, or timeliness of any information on the Site. Service availability, pricing, and equipment specifications are subject to change without notice.
Third-Party Links. The Site may link to third-party websites. HVAC Loyalty is not responsible for the content, privacy practices, or operation of third-party sites.
User Submissions. When you submit a request, photo, review, or other content through the Site, you grant HVAC Loyalty a non-exclusive, royalty-free, worldwide license to use that content for service delivery, internal operations, and (where applicable) marketing purposes. You represent that you have the right to submit such content.
13. SMS / Text Message Communications
By providing your mobile phone number and opting in via the contact form or service agreement, you consent to receive SMS text messages from HVAC Loyalty regarding your service request, appointment confirmations, technician arrival notifications, and service follow-up. Message frequency varies based on your service activity. Message and data rates may apply per your mobile carrier’s terms.
You may opt out of SMS communications at any time by replying STOP to any text message you receive from us, or by contacting us at the information in Section 16. Opting out of SMS does not affect your ability to receive service from HVAC Loyalty but may delay communications about your appointments.

14. Intellectual Property
The HVAC Loyalty name, logo, brand colors, photographs, written content, designs, and other Site materials are the property of HVAC Loyalty or our licensors and are protected by United States copyright, trademark, and other intellectual property laws.
You may not reproduce, copy, distribute, modify, create derivative works of, publicly display, or commercially exploit any Site content without our prior written permission. Brief quotations with attribution and a link back to the Site for journalism, education, or fair use commentary are permitted.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, applicable laws, or industry practices. Material changes will be posted on this page with an updated “Last Updated” date. For active service customers, material changes will be communicated by email when reasonably practicable.
Your continued use of our services after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, please discontinue use of our services and contact us to close any active accounts.
